noctovisor.com does not show a cookie banner, and here is why

The site sets no cookies of its own. There is no analytics, no tracking pixel, no advertising technology, no embedded video and no third-party fonts. Nothing on the page identifies you, follows you to another site, or reports your visit to anyone. Whatever code the page runs is ours, it stores nothing on your device, and it sends nothing anywhere. You can confirm all of that yourself: read the page source, and watch your browser's network panel while the page loads: every request goes to noctovisor.com and nowhere else.

The only cookie you are realistically likely to pick up is __cf_bm, which Cloudflare sets to tell automated traffic from human traffic as requests pass through its proxy. If you are ever shown a security challenge you may also pick up cf_clearance and a few short-lived challenge diagnostics. Cloudflare's other cookies belong to products we do not use, so they do not appear here. In practice a visit leaves you with one cookie or none.

Under art. 399 of the Polish Electronic Communications Act (Prawo komunikacji elektronicznej, implementing Article 5(3) of the ePrivacy Directive), storing or reading information on your device requires prior information and consent, except where it is necessary to transmit a communication or to deliver the service you actually asked for. A bot-detection cookie set by the network that delivers the page falls within that exception.

So no consent is required, and there is nothing a banner could ask you to consent to. What art. 399 does require is that we tell you clearly what is happening, which is the job this notice does.

We hold that position narrowly. We do not claim that anything a provider labels "strictly necessary" escapes consent: that is a provider's label, not a legal test. We claim the exception for one thing only: a bot-detection cookie without which the site cannot be served reliably.

What the site is

A static site, served through Cloudflare. No login, no dashboard, no account area, no session. The stylesheet and the two typefaces are served from noctovisor.com itself: no font service, no content delivery network of someone else's. It loads nothing from any other server.

There is one form on noctovisor.com, for starting a free 30-day watch. Submitting it posts what you typed to noctovisor.com itself, where our own code relays it as a single email to our contact mailbox; it is not stored at the edge, and it never passes through a third-party form service. The form runs no script of its own: it sets no cookie, stores nothing in your browser and reads nothing from your device.

Customers have a second one, at comment.noctovisor.com. Every alert carries a link to it, and the page lets you mark what you did about that alert or write a line about it. It is our own code on our own server, it sets no cookie and stores nothing in your browser, and it holds no session: the link in your email is the only thing that identifies which alert you are answering. It runs about ten lines of script, and all they do is let you click a mark a second time to take it back. With scripting switched off the page still works; you just have to pick a different mark instead of clearing one. The page shows you the alert's reference and nothing else, so a link forwarded to a colleague discloses nothing about the companies you watch.

There are outbound links to source documents: court dockets and registers on other sites. Following one takes you to that site, which has its own cookies and its own notice. The same is true of the source links in our alerts: we link to originals so you can check them, and those originals are not ours.

Controlling cookies

Every current browser lets you block or delete cookies per site. Because the only cookies here are Cloudflare's security cookies, blocking them mainly means you may be shown a security challenge more often, or in an unlucky case be prevented from reaching the site. Nothing else on the page depends on a cookie. If you prefer not to interact with the site at all, email contact@noctovisor.com and we will answer that way instead.

The forms

People ask this here, so it is answered here. The watch form has two fields and a consent box: your work email, and the list of companies you paste in. Anything else you want us to know, you write in the message yourself. That list is confidential from the moment you send it, whether or not you become a customer, and if you do not become a customer it is deleted within 90 days of the end of your watch (or of sending, if you never started one) without you having to ask. The privacy policy covers all of this in full.

The comment form asks for nothing about you at all. It has three buttons and a text box, and what it records is the mark you chose, whatever you wrote, and the time. Not your address, not your name, not your IP address, not anything about your browser.

We do not add form submitters to a marketing list. Polish law requires prior consent for direct marketing by electronic communication and applies it to business recipients too, so we reply about what you asked and nothing else.

Changes

The version and date at the top tell you which text you are reading. If we add anything that stores or reads information on your device, analytics included, we will update this notice before the change goes live, and where consent is required we will ask for it, with a real choice, before anything loads.
